But Malibu directly has never published an MSRP to my knowledge.

Not at all corrrect.  I recall looking in 2010 that MSRP was published.  Nadaguides.com has them listed.  I do not know if they still do, but  the dealer is advertizing a Manufacturer's price.  If it said "Suggested Retail Price", they could get away with it.  But to use MSRP is clearly deceptive marketing.

Like I said, to "my" knowledge.  I didn't know they did so in 2010.  Regardless that was 10 years ago and not relative to the 2021 model discussion.

However, to my point, the Malibu website does not state a MSRP, which is a "Suggested" retail price.  That's what the "S" is in MSRP.  Nada does not show current year MSRP boat values for Malibu, so your argument with respect to the discussion on 2021 models has no foundation.  Just as your post with the dealer showing the MSRP is different than if posted by Malibu on their site or in their publications, which again to "my" knowledge does not get published, has no merit in the discussion.  Note that they only posted it for the "value" model line, the "LX" line.  So, they can get away with it because there is nothing illegal going on here.

Don't be mean, people.

Regardless, we have established based on the witness testimony that some dealers use the same MSRP, and there are definitely others that make up their own.
