I had to call Cipa to get the instructions.  You have to totally take it apart, and inside there are a couple of screws (hex screws I think?) that you can tighten.  The mirror should not be moved up and down without popping up the lever on the bottom of the bracket.  The lever should tighten it just a bit when it's secured onto your windshield.  Once you tighten those screws inside, it should stay tight and not fold down when going over waves, etc.  I'm not sure if I can find the actual instructions they sent me, but if you take the bracket apart it's obvious what screws to tighten.

Following up on this to clear the air. This is pretty simple. You do have to take the mirror all the way apart, which kinda sucks, but it was a ten (maybe) minute job. 

  1.  1/4" hex screw to take the mirror off the frame and take the clamping piece that secures to the windshield frame off
  2. Two 3/16" hex screws to take apart the clamp
  3. Inside the clamp there is two 7/16" nylon lock nuts that can be adjusted to increase or decrease the tension on the pivot joint.
  4. Put it all back together.

Skiing today, so will test it out. It is true, as mentioned above, that it can be set too tight so that even with the lever open, you can't fold the mirror down.
