Simple or complex "trim tabs" don't infringe on Malibu's patent. Only if they protrude out in a sideways direction, which would then infringe on Malibu's delayed convergence patent. Up and down trim tabs have been around for years so they are not part of Malibu's patent. As long as they just go up and down and not sideways.

Somebody had to pull the trigger, I could not wait any longer for results. Going to pick the boat up tomorrow, can't wait to start playing around with it. This video was only after about 30 minutes of testing. I was told that today they were able to dial it in with MUCH better results...........will keep you posted, supposed to rain/storm all weekend here.

Should be updated video from today's test up later tonight or tomorrow.

If I was retrofitting a boat for surf I'd go NSS knock off long before a surf gate clone, I still think the Malibu engineers are going duh why didn't we do it that way. Will be interesting if Malibu goes after aftermarket like they did nautique for patent infringement.

These tabs (or tabs like them i.e. Gen2) don't infringe on the Malibu patent. Vertically deploying tabs are safe. The Malibu patent is very specific in that the tabs or device needs to deploy horizontally at less than a 30 degree angle.

From what I understand the wakesurf assist guy has his own patent now too.
